EU preliminary ruling on ETS rejects ATA case

Advocate General of the EU’s Court of Justice says aviation will not be exempt from the emissions trading scheme.

The European Court of Justice's (ECJ) advocate general has issued a preliminary ruling that any airline flying in or out of the EU will not be exempt from the EU emissions trading scheme (ETS). The ruling also states that ETS does not violate international law. The scheme is due to take effect January 1 2012, and all airlines flying into or out of Europe are meant to abide by the scheme.
